The purpose of the environmental compliance obligations procedure is to outline your organization’s methodology for identifying, complying with, and monitoring environmental compliance obligations. The compliance obligations and other requirements relate to environmental aspects that are identified when analyzing the context of your operations and product life cycle(s).
Strive to meet your mandatory and voluntary commitments made in your environmental policy. The environmental compliance obligations procedure describes how to identify and monitor applicable environmental compliance obligations and other requirements that have the potential to introduce new risks or opportunities that relate to your significant environmental aspects.
The environmental compliance obligations procedure has been developed to assist in meeting the requirements of Clause 6.1.3 of ISO 14001:2026 - Compliance obligations. Under ISO 14001:2026, compliance obligations are to be available as documented information, and they feed into the determination of risks and opportunities (6.1.4) and planning action (6.1.5).
The EMS Manager should form a review team comprising relevant department managers to actively identify any relevant mandatory and compliance obligations and other requirements and determine how impacts associated with noncompliance should be mitigated. The EMS Manager should employ several techniques to track, identify, and evaluate applicable, related compliance obligations and other requirements.
The environmental compliance obligations procedure includes four essential form templates referenced from the procedure, supplied in .docx and .xlsx formats that can be retained as hard or soft copies.
Your organization should maintain an indexed list of relevant compliance obligations and other requirements, such as standards and procedures concerning identified environmental aspects, by referencing the minimum acceptable legal, industry standards, and technical specifications against your facility’s associated equipment and operating routines.
The compliance obligation register must be reviewed and updated every quarter for adequacy of new and updated regulations and communicated to relevant staff whose responsibilities affect compliance.
Determine which needs and expectations of interested parties are to become compliance obligations, and determine the legal requirements related to your environmental aspects. These may arise from mandatory requirements, applicable laws and regulations, voluntary commitments such as organizational and industry standards, contractual relationships, good governance and community principles, and ethical standards.
Organizations can take advantage of new opportunities by building on current strengths, anticipating future trends, introducing new technology, developing new products or services, capturing and disseminating lessons learned, sharing and promoting good practices, opening new markets, and attracting new customers.
A SWOT analysis can uncover areas of the business that are holding you back or that your competitors could exploit if you do not protect yourself. Many criteria will apply to more than one quadrant in the matrix. Identify the criteria appropriate to your own situation. The relevance of internal climate change considerations should be captured in this document.
A workshop approach is often best when undertaking a PESTLE analysis. Organizations should include climate change as an external issue in their PESTLE analysis and make a statement on its relevance. This should be discussed during management review meetings and recorded in the review meeting minutes.
